Open Letter to Travis Osborne who accuses Auto Hero of Brand Jacking in a recent linkedin Post<\/a><\/strong><\/p>\n

Dear Travis,\u00a0<\/span><\/p>\n

Brand jacking, that’s a long shot.\u00a0<\/span><\/p>\n

I was going to let this slide, but to be accused of deceptive and misleading conduct such as \u201cBrand jacking\u201d I don\u2019t think I should allow you a hall pass this time.<\/span><\/p>\n

For those who don’t know, Brand Jacking is Domain squatting, Social media impersonation or trademark infringement to name the big three, none of that is happening here at all.<\/span><\/p>\n

Let me\u00a0 be clear, We are not pretending to be the Mobile Tyre Shop.<\/p>\n

We have our own reputation and don’t need yours.<\/span><\/p>\n

Travis’s post is disappointing and misleading for three reasons.<\/h2>\n

1.You have accused our company of stealing something from you that you do not own.<\/span><\/p>\n

2. You know our company and myself, and if you have an issue you could have just called me, but instead you chose to accuse us of deceitful conduct in a public domain that many of my industry contacts will see, no doubt to shame me and hurt my reputation all for a few likes.<\/span><\/p>\n

3. I always recommended and encouraged customers to call Travis’s business when we get work Auto Hero couldn’t accommodate. (That won’t be happening anymore)\u00a0<\/span><\/p>\n

Travis’s Business Name.<\/h2>\n

There is nothing original about the business name Travis decided to use.<\/span><\/p>\n

The three words \u201cMobile Tyre Shop\u201d are words that describe a service he did not invent and can not be trademarked or owned because they are generic terms. These same three words have been used universally within the tyre industry for decades.<\/span><\/p>\n

What is a trademark?<\/h2>\n

\u201c<\/span>In order to be trademarked, a word or phrase must have some level of distinctiveness from other words and phrases used to describe similar products. <\/span>Generic terms are not considered distinct enough for trademark protection because they refer to a whole class of products or services<\/span>\u201d <\/span><\/p>\n

“If generic words could be trademarked, you’d find the entire dictionary would be unusable and illegal”<\/span><\/p>\n

These three words have been used by other Mobile Tyre Shops and other stores in various combinations long before Travis decided to claim ownership.\u00a0<\/span><\/p>\n

Travis even describes on his website the idea that was not original to him.\u00a0<\/span><\/p>\n
